A Socio-Historical Study of Women's Rights Advocacy in Islamic Legal Construction

This article presents evidence that the construction of Islamic law is influenced by women's voices, experiences, and problems. It also offers a critique misogynistic narrative law. Adopting socio-historical approach with perspective, this research demonstrates inadequacy current studies argue places women in an inferior subordinate position to men. Critical analysis asbabun nuzul text Qur'an primary analytical tool used study. Polygamy, khulu', zhihar, inheritance are four main issues examined, study shows complaints advocacy played critical role shaping system. Women's perspectives serve as spiritual foundation development cannot be disregarded. By considering perspectives, fair benefits can realised, sense justice achieved for vulnerable groups, such women.
